            In the name of the Commonwealth aforesaid, you are hereby required to notify and warn the inhabitants of the Town of Egremont qualified to vote in Town affairs, to meet at the Mt. Everett High School Auditorium, in Sheffield Mass., on Tuesday, May 5, 2009 at 6:00 PM in the evening, and then and there to act on the following articles:

 

ARTICLE 1: To see if the town will vote to transfer from available funds the sum of $11,141.94, or any other amount, to cover the costs of an emergency repair to a broken water line, or to take any other action relative thereto.

ARTICLE 2: To see if the Town will vote to transfer from available funds the sum of $852.22, or any other amount, to cover the state mandated payment to the Berkshire Regional Planning Commission, or to take any other action relative thereto.

ARTICLE 3: To see if the Town will vote to transfer to Veteran’s Expenses from available funds the sum of $5,916.39, or any other amount, to cover the state mandated payment for Veteran’s Services and Veteran’s Benefits, to take any other action relative thereto.

ARTICLE 4: To see if the Town will vote to transfer from available funds the sum of $4,920.00, or any other amount, to the Fire Department Accident Wages account to pay for an injured fireman’s wages for the balance of Fiscal Year 2009, or to take any other action relative thereto.

ARTICLE 5: To see if the Town will vote to transfer from available funds the sum of $807.84, or any other amount, to the Fire Department Accident Health Benefits account to pay for an injured fireman’s health benefits for the balance of the Fiscal Year 2009, or to take any other action relative thereto.

ARTICLE 6: To see if the Town will vote to transfer from available funds the sum of $4080.00, or any other amount, to reimburse the Reserve Fund for monies advanced to the Fire Department Accidents Wages Account , or to take any other action relative thereto.

ARTICLE 3: To see if the town will vote pursuant to M.G.L. c 71, §16B, as amended, to amend Section 4 (e) of the SBRSD Regional Agreement as follows:

For Fiscal Year 2010, each member town’s share of the total operating and transportation budget of the District (“Assessment”) shall be the amount determined as follows: the district treasurer shall calculate each member town’s share of the District’s total operating and transportation budget using the alternative assessment method as set forth in the amendment to the SBRSD Regional Agreement voted in May of 2001 and shall then multiply such share by fifty percent (50%) (the “Alternative Method Portion”). The district treasurer shall then calculate each member town’s share of the District’s total operating and transportation budget using the Statutory Method and shall then multiply such share by fifty percent (50%) (the “Statutory Method Portion”). The district treasurer shall then calculate each member town’s actual Assessment for Fiscal Year 2010 by adding the Alternative Method Portion to the Statutory Method Portion.

For Fiscal Year 2011, each member town’s share of the total operating and transportation budget of the District shall be the amount determined as follows: the district treasurer shall calculate each member town’s share of the District’s total operating and transportation budget using the alternative assessment method as set forth in the amendment to the SBRSD Regional Agreement voted in May of 2001 and shall then multiply such share by twenty-five percent (25%) (the “2011 Alternative Method Portion”). The district treasurer shall then calculate each member town’s share of the District’s total operating and transportation budget using the Statutory Method and shall then multiply such share by seventy-five percent (75%) (the “2011 Statutory Method Portion”). The district treasurer shall then calculate each member town’s actual Assessment for Fiscal Year 2011 by adding the 2011 Alternative Method Portion to the 2011 Statutory Method Portion.”, or to take any other action relative thereto.

ARTICLE 4: To see if the Town will vote to raise and appropriate and/or transfer the sum of $1,268,083.00, or any other amount, to fund the FY 2010 Operating and Transportation budgets of the Southern Berkshire Regional School District, or to take any other action relative thereto.

ARTICLE 5: To see if the Town will vote to raise and appropriate and/or transfer from available funds the sum of $1,234,462.00, or any other amount, to fund the FY 2010 Operating and Transportation budgets for the Southern Berkshire Regional School District Budget, or take any other action relative thereto.

ARTICLE 11: To see if the Town will vote to raise and appropriate, and/or transfer from available funds, and/or borrow, and/or accept grants in the sum of $500,000.00, or any other amount, to construct a Police Station, or to take any other action relative thereto.

ARTICLE 12: To see if the Town will vote to raise and appropriate and/or transfer from available funds the sum of $20,200.00, or any other amount, to deconstruct the so-called Annex Building, or to take any other action relative thereto.

ARTICLE 13: To see if the Town will vote to raise and appropriate, and/or transfer from available funds, the sum of $9,000.00, or any other amount, to purchase a new zero-turn mower for the Buildings and Grounds Department, or to take any other action relative thereto.

ARTICLE 15: To see if the Town will vote to raise and appropriate, and or transfer from available funds, the sum of $35,360.00, or any other amount, to a Fire Department Accident Wages account to cover the wages of a Fireman injured in the line of duty, or to take any other action relative thereto. (This amount of money is being fully reimbursed by the Police & Firefighters Accident & Disability insurance.)

ARTICLE 19: To see if the Town will vote to accept funds being provided by the Commonwealth of Massachusetts under the provisions of Chapter 90 of the General Laws, to pay for such costs as allowed by appropriate legislation in

connection with the maintenance, repair, and construction of Town ways and bridges, or to take any other action relative thereto.

ARTICLE 20: To see if the Town will vote to authorize the use of revolving funds for the following programs and purposes:

       a. French Park ($2,000.00)

       b. Home Composting Bins ($500.00)

       c. Zoning Board of Appeals ($1,000.00)

       d. Dog Fund ($1,000.00)

e. Inspector Wages ($15,000.00) (exceptions: Building Inspector and Health Inspector)

which revolving funds together shall not exceed the sum of $19,500.00, which shall be under the control of the Town Treasurer, which shall be accounted for separately and to which shall be credited only the departmental receipts received in connection with the programs supported by each revolving fund; further to authorize the Town Treasurer to expend from such funds in accordance with the provisions of M.G.L. Chapter 44, Section 53E1/2 as amended by Section 72 and 73 of the Acts of 1994 of the Massachusetts General Laws, provided however that said expenditures for all revolving funds shall not exceed the receipts for such funds, or to take any other action relative thereto.

 RESOLVED: All Town of Egremont property tax payers have the same right to speak at the Town’s Annual Meeting and all other town meetings as those who are registered to vote in the Town of Egremont, subject to the right of the Egremont Town Moderator to maintain order at Town Meetings.

ARTICLE 22: To see if the following section shall be added to General Bylaw 1 of the Town of Egremont, or any other action taken with respect to the subject matter thereof:

Section 10: With respect to nonregistered voters, and in accordance with past practice, the Moderator shall decide (either in general or on a case-by-case basis, or both) in his discretion which persons, if any, may speak at Town Meeting and the restrictions and limitations thereon.

ARTICLE 23: RESOLVED that the Selectboard is hereby urged to seek reimbursement of the costs incurred by the Town (including any increase in the Town’s insurance costs) in defending legal actions against the Town brought by nonresident voters seeking the “right” to speak at Town Meetings; and the Moderator is hereby urged not to permit to speak at Town Meeting any such nonregistered voter unless and until such person has reimbursed the Town for such costs.

ARTICLE 24: Section 4 of Bylaw 1 of the Town of Egremont is amended by changing the phrase “The presence of sixty (60) voters at a Town Meeting for the transaction of business shall constitute a quorum” to read “The presence of one hundred (100) voters shall constitute a quorum for the transaction of business at a Town Meeting”.

ARTICLE 25: To see if the Zoning Bylaw of the Town of Egremont shall be amended as follows, or in some different manner related to the subject matter of the following:

(1) The following subsection c is added to section 4.1.1.3:

c. Used and structures for wireless telecommunications services authorized by the Board of Selectmen by special permit in accordance with the provisions of this Bylaw. Any such use or structure that is not the principal use or structure on a lot or parcel shall be deemed an accessory use or accessory structure on such lot or parcel regardless of the nature of the principal use or principal structure on such lot or parcel.

(2) Sections 3.1.13b, 3.2.4, 5.2 and 5.3 and all subsections of each thereof are deleted in their entirety.

(3) The following words are deleted from section 4.1.1.3b: “other than those provided for in Section 5.2 and 5.2 of this Bylaw”.

(4) Note 2 to section 4.1.2 is amended by adding the following after the word “antennae”: “,monopoles, towers or other structures supporting antennae, other communications or utility structures or equipment”.

ARTICLE 26: To see if the Town will vote to adopt a Common Driveway bylaw as follows:

General Requirements and Restrictions:

A. Permits. Any abutting property owner(s) desiring to gain access to a way by means of a common driveway that serves no more than four (4) dwelling

    units may do only in accordance with the provisions of a permit issued by

    the Board of Selectmen.

B. Number of units accessed. A common driveway shall provide access to no

    more than four (4) dwelling units.

C. Frontage. Frontage on a common driveway may not be used to satisfy zoning

    frontage requirements. Each lot passed by the common driveway shall have

    access on a way acceptable to the Planning Board.

D. Design Requirements. Design requirements for common driveways shall in the opinion of the Board of Selectmen and the Highway Superintendent,

    assure adequate safety and access for emergency vehicles.

E. Origin of driveway. A common driveway must originate on approved frontage and must observe a twenty-foot setback from the side line between the lot

    of origin and a lot not served by the common driveway.

F. Minimum width. The traveled way shall have a minimum width of fourteen (14) feet.

G. Easements. The application for a common driveway must be accompanied by

    a declaration of covenants, easements and restrictions for the use and

    maintenance of said common driveways.

H. The sale of lots and/or erection of buildings is prohibited until such

    time as the common driveway has been constructed in accordance with the permit approval plan and until the Board of Selectmen have written

    verification that all covenants, easements and restrictions have been

    recorded in the Southern Berkshire Registry of Deeds.

ARTICLE 27: To see if the Town will raise and/or appropriate the sum of $2,500.00 or any other amount for the purchase of supplies such as blankets, cots, non-perishable foods bottled water and basic necessities with which to stock an emergency shelter(s)in Egremont in the event of a natural or man made disaster.

ARTICLE 28: Will the Town discontinue Nicholson Road from the easternmost common boundary of Catamount Development Corporation (assessors Parcel 008.0-0000-0689.0) and Hakim (Assessors Parcel 008.0-0000-0718.0) to the State Line, or act on anything relevant thereto?

ARTICLE 29: To see if the Town will authorize the appointment of any committee or committees and give them or any other officer of the Town any instructions, authority, or indemnity.
